HEALTH NEWS - Trade union Solidarity has convinced the high court in Pretoria to declare certain sections of the National Health Act unconstitutional, hereby dealing the controversial National Health Insurance (NHI) Act a huge blow.
The sections in question stipulate that government have the right to determine where private doctors and medical professionals may practice and where private hospitals should be built.
Judge Anthony Millar ruled that government do not have this right and that the Certificate of Need (CON) scheme that says where health professionals should practice, would lead to government control of the private sector.
Solidarity won its case with costs.
